ДОГОВОРЕННОСТЬ О ПРАВИЛАХ И ПРОЦЕДУРАХ, РЕГУЛИРУЮЩИХ РАЗРЕШЕНИЕ СПОРОВМеханизм урегулирования споров Генерального соглашения по тарифам и торговле всегда рассматривался в качестве одного из основополагающих элементов многосторонней торговой системы. Договоренность о правилах и процедурах, регулирующих разрешение споров, которая была выработана в ходе переговоров «Уругвайского» раунда, является значительным шагом вперед, повышающим эффективность процедуры урегулирования споров в рамках ВТО. По сравнению с процедурой, существовавшей в ГАТТ 1947, значительно повышен автоматизм функционирования механизма урегулирования споров:
Важной характеристикой механизма разрешения споров ВТО является то, что созданная им система является интегрированной, то есть любая страна-член ВТО имеет право представлять свою жалобу, базируясь на положениях любого из многосторонних соглашений, приложенных к Соглашению об учреждении ВТО.
Если спор между сторонами не разрешается путем консультаций, предусмотренных процедурой, то на заседании ОРС создается третейская группа экспертов. Подобные группы обычно состоят из трех человек, имеющих необходимое образование и опыт работы и не являющихся гражданами стран, вовлеченных в спор. В Секретариате ВТО ведется специальный реестр экспертов, отвечающих этим критериям.
Одним из центральных элементов механизма урегулирования споров ВТО является положение о том, что страны-члены не имеют право самостоятельно определять, были ли нарушены их права по соглашениям ВТО и вводить встречные меры. В подобных случаях они обязаны прибегать к правилам и процедурам, предусмотренным механизмом разрешения споров ВТО.
