Issue of guarantees is to be agreed upon with Owners. i) Compile time sheets which are to be provided with signatures of the representatives of the shippers or receivers; k) In accordance with the Owners' instructions given separately in each particular case or in accordance with the Master's request to render for the Owners' account the following services to the vessel: supply bunkers, provisions and stores and arrange medical attendan ce for the ship's crew; to provide for tallymen and winchmen; to arrange for ship repair, overtime work of stevedores and work on Sundays and Holidays. Before rendering such services Им- Agent is obliged to inform the Owners' representative or the Master of the ship about the cost of the services; 1) Assist the Master during delivery of the vessel to the timecharter or her redelivery from the time-charter; m) Make every effort to arrange receiving/delivery of- cargo alongside the vessel; n) At Owners' request to exercise a lien upon the cargo for payments to the Owners; o) Arrange and/or settle other matters (pertaining to servicing of vessels) the Agent has been entrusted with by the Owners; p) The Agent is authorized to appoint with the Owners' previous approval his Sub-Agents at the ports whict are not served by himself but which are covered by this Agreement. § 3 The remuneration of Sub-Agents appointed by the Agent should be most favourable. Any rebates allowed by the Sub-Agents to the Owners shall be passed on by the Agent to the Owners without any deduction in favour of the Agent. §4 The Agent's remuneration is fixed as per the Annex to this Agreement. The remuneration of a Sub-Agent is included in the remuneration of the Agent. § 5 The Agent is obliged to provide the Owners with all official tariffs, regulations, etc. in force, pertaining to the services rendered to vessels at the ports covered by this Agreement, as well as with all amendments thereto. § 6 The Owners have the right to conclude agreements directly with stevedores, ship chandlers, pilots, tally-, tug- and other contractors and to turn over these agreements to the Agent for execution. § 7 The Agent has to dispatch to the Owners ship's disbursement accounts with supporting vouchers within thirty days of ship's sailing. All the supporting vouchers should be approved by the Master and accepted by the Owners' representative at the Trade Delegation of the U.S.S.R. in France. The Owners shall pay the disbursement account produced by the Agent within 30 days after receipt of the account. Any payments between the Owners and the Agent to be effected in accordance with the terms and conditions of the payment agreement existing between the U.S.S.R. and the country of the Agent, if any. I Postal and telegraphic expenses will be refunded to the Agent by the Owners as far as they concern direct correspondence with the Owners regarding loading, unloading, stay, arrival or sailing of vessel and also concerning cargo loaded or unloaded by the vessel. The Owners will also reimburse the Agent for telegraphic and postal expenses connected with the Agent's replies to inquiries of the Owners. All the Owners' claims will be settled by deducting the respective amount from the subsequent accounts of the Agent and in the absence of such accounts claims will be settled by the way of remitting directly to the Owners the amount collected in excess by the Agent. § 8 The Agency Fee may be increased only on written mutual agreement of the two parties hereto. §9 The Owners will be at liberty to place their employee in the Agent's office. This employee will be paid by the Owners. The Agent will provide him free of charge with proper office accommodation and facilities for his work and will introduce him into all branches of work stipulated by this Agreement. § 10 The Agent is fully accountable to the Owners for improper or inefficient execution of this Agreement as well as non-compliance with any clause in this Agreement and shall refund to the Owners all damages and losses resulting from any act or omission of the Agent, his Sub-Agents or Contractors, contrary to this Agreement. § П Forwarding services (viz.: transportation of goods to the port, concentration of goods in the port before commencement of loading, collecting of information from Sellers regarding preparation of goods sold, storage of cargoes in the ports, etc.) are to be rendered only on separate order of the Owners. § 12 Any dispute between Owners and Agent arising in the course of fulfilling this Argeement to be referred for settlement to the Maritime zAxbitration Commission of the U.S.S.R. Chamber of Commerce and industry in accordance with the rules of this Commission. § 13 This Agreement is made for an indefinite period of time and can be cancelled subject to a two month written notice thereof. This Agreement comes into force on the 1st of January, 19... § 14 Upon signing this Agreement all previous Agreements concerning the Agency in France become null and void.
